Have I missed some very vital info while I read all previous posts?
As far as I understood, someone ddosed the web-site and sent the Dark Byte a warning letter about legitimacy of the content on the web-site.
Did it say who sent this letter? Which game developing company or organization sent it?
I agree with other people - it might be easilly some fat b**tard who writes his own trainers and sells them on black market for high dolla.
I am 100% sure it's not gonna be a lawsuit - it's just some punk who scares other people with such letters just to get them out of the way... |

The email was from ESA (confirmed) and it was a C&D letter.
Yeah it sucks but it seems like the future now. _________________

So DB actually received a document on paper later? Or still just the email? |

Although emails can be more easily disputed as authentic, the validity of a cease and desist letter (assuming that it is, indeed, authentic), presents itself without question -- regardless of whether or not that notification was delivered via email or via postal mail etc., and as such, should be taken seriously. |

Aren't they only legal if they come through your ISP or is that only in Britain? |

Starting in January this year, all internet piracy and infringement notices have to go through the ISP first to be legal in the UK. Not sure why, but law here always was a bit confusing.
Edit: Actually looking it seems to be voluntary on the part of ISP's to send notices to anyone they think is pirating or infringing on copyright.
It's just like the British government to make a law and then make it voluntarily enforced. |

Probably to prohibit abuse of excessive and/or erroneous claims.
If someone lives near a MacDumpster's in London and connects to their open WiFi connection, and starts distributing copyrighted works via torrent or an online forum, who is responsible? The ISP? The owner of the MacDumpster franchise? The web hosting company? The owner of the forum? The distributor of said protected works? And if the latter, how does one go about contacting them? How can you even prove that they are doing it? Some things can be spoofed. The ISP acts as a filter in this case.
However, we are not talking about piracy, and in such cases where proof of infringement is clear, then justification for presenting a cease and desist notice becomes less questionable. In such a case where obvious infringement may occur, and the guilty party (or responsible party) may be easily identified, then contact with the ISP and/or such notices being transferred through that ISP may be unnecessary. Wouldn't you agree?
But...I can only surmise.
And this doesn't even touch on breach of privacy...assuming that we can even believe in such a thing. |

Wow, that is sad I mean i thought few weeks down the line once this noise is settled, the sections would be opened and we could all go back.
The alternatives are great but they don't get nowhere as much attention as these forums and both as a trainer and table maker, i enjoyed the recognition and the number of downloads, i am sure so did the others if not all.

Wow, that sucks.........this site has been around for years and all of a sudden they decide to have a go now?
I find it funny that this site gets hit, yet Cheat Happens has not been touched and they charge for Trainers.

DB got a mail with a cease & desist aka a violation to the DMCA from the ESA. Details are a bit vague like no specific info what infringements have been made etc. but it seems to be legal (at least that's what DB thinks I have my doubts but then again I don't know sht about law)
we moved over to the site that's in STNs signature. |
