The same if it were private. It is up to the game company/publishers to pursue action against you. Some companies wont care and will leave you alone, others will fight til you are removed from the internet. It all depends on the company of the game.

I have looked all over the internet for discussions like this, so please can somebody advise me on this:

I am making cheaters/trainers for games which change the game progress files. For example a racing game would only allow you to buy a car if you reach a certain reputation, but my cheater would just change the saved game file so you'll already own the car without the required reputation.

If I'd sell that trainer, I don't think I infringe on any DMCA, am I right?

Now, suppose that within the racing game, the original game makers have given you the option to skip the reputation requirement and buy the car anyway. This is done through an in-app purchase. Now my trainer is in direct competition with the original game maker, although I do not sell reputation points like they do.

So in this second scenario, am I infringing on DCMA, or in any other way doing something illegal?

No idea, but some games have a license agreement where everything you make regarding their intellectual property becomes theirs. That includes drawings, sounds, and probably also trainers

Then there's the thing of making a derivative work of the original with your trainer (The trainer basically makes a new game and stealing 99.9999999% of the original game)

Then again, I never sell trainers or tables so don't know the details.

DarkByte, thank you for your thoughts on this.

About the TOS, that might be game specific, so that might be right in some case (maybe the majority of cases, I have no clue).

But regarding turning it into a new game, how so? It is still the original game you play. Nothing is changed or copied or added to the game itself; the trainer just makes it possible to reach certain objectives of the game earlier, but those objectives were meant to be reached and are not some obscure, inaccessible part of the game or something new.

I've never seen a game company try to sue, shutdown, or terminate anyones site for releasing save game editors. Not to say they can/can't but I've personally never seen it.

Given that you are selling it though, that gives them more incentive to go after you since you are profiting off of modifying their work.

Depending on the country really.

Then again, game makers have a habit of putting such crazy EULAs regardless.

If it was up to me it'd be: Ok to make and use in single, against EULA to use in online play.

Otherwise soon it's gonna be like you don't own a SINGLE bit on YOUR machine.
And that's just wrong.

Bigpoint actually sent me a cease & desist for my Seafight Bot that I was profiting from. I guess that is what happens when you are the first of the search results.

Wasn't a big deal sales were dropping off other bots were released still make money off ads
