I am trying to use CS3. Also i got this weird thing that when i try to copy layers it doesnt show its self on the bottom right corner thingy

In the future, you may want to use Photoshop to also crop your screenshots down to remove all the useless junk when asked for help. No reason to upload a pic that contains your 2nd monitor (from the look of it) of the forums.

Background is locked. Right click the Background Layer, select New Layer from Existing or some such. Then delete the locked Background layer, this new BG layer should be fully editable as well.

sorry but can u say that IN low english form? cause i dont get it well

You see your layers in the bottom right corner?
How it has an icon of a pretty looking lock on it?
Right click that layer. Anywhere should be fine, and it should bring up one of those super helpful RIGHT CLICK MENUS -- Now, what you need to do, is look down that list for the menu item called either "New Layer from Existing" or "Duplicate Layer" something along those lines.
After it has made a new layer (There should now be TWO layers in the area where the layers are in the bottom right hand corner), right click the same background layer (That one with the pretty lock on it) to bring up that super helpful RIGHT CLICK MENU and select "Delete" or "Delete Layer"

That can explain better than I can. Just tested in CS4 if I have a locked Background Layer selected I can not use the gradient tool either. I have to either unlock it or as ZacTheSin stated right click and create a new copy of the current layer. Then I have to delete the original background layer.
