okay, ive been trying to portforward 25565 and ive done it to firewall of att 2wire modem and now it still wont work and minecraft is saying failed to bind to port.

Add minecraft server to firewall's exception list and make sure you made your ip to static from dynamic.

that's an issue with how you have it set up in the settings for minecraft, not the actual port forwarding, i believe.
This is an OLD server settings file for the server I ran. I had issues with "cannot bind to port!" until I set the IP and port like this:
Note that I left the IP BLANK.
Update:
Downloaded the 1.8.1 server:

Back in "the day," that used to happen when the server hadn't killed it's java process properly and was still binded to the port on your computer.
Kill all "java.exe" processes and try again.
If that doesn't work, restart your computer and try again.
