I have 10.6 installed myself (this card is from december 2009)
So yeah it might be a bios issue after all!!

My card was purchased in feburary of this year. But again, this did not happen on 10.4 drivers. I asked around steam a few months back and it also happened to some 5770 cards. This also happened on 10.5 drivers.

(Mind you I am talking GPU Bios)
Do you have the card with the large heatsink on it by stock? If so depending on the model you could just flash it/change the P settings.
If you wanna risk it.

Was about to post about this.
Looks decent, I was gonna get a HD 5850 for my new rig, but I might consider getting this instead.
I know that the GTX460 does not directly compete with the HD 5850, but the HD5850 was a bit out of my budget range anyways, so now I have a bit of extra cash to get a bit more RAM, or maybe invest into a large HDD.
About time nVidia released something competitive.

Don't get the GTX465. It's a piece of crap.
