1.Does jail breaking a ipod require hardware work, or just software work..
2. is there a way to restore after its done
3. It just allows me to put my own games, and apps on for free right?

Since I actually HAVE an iTouch.
What it does is replace your iTouch's OS with a slightly modified one, putting 2 different default apps in.
These are installer apps. They're much like apt-get in linux.
From here you can install many other apps, such as OpenSSH to give you access to the iTouch's file system, allowing you to add cracked apps.
Then there's winterboard, a theming app.
There are hundreds more apps, just have a look.
It can easily be un-done(Just click restore in iTunes).
I would go ahead, I did it fine.
If you want to ,http://www.ipodtouchfans.com is a good site

Easilly reversable, just hold down both buttons on your ipod/iphone then plug in and hit restore.
I have a 16gb jail broken ipod touch, it works great.

What I'd do is pretend that the firmware corrupted when updating to the new firmware(legally of course) then restore it. Then I'd send it in for service.

Didn't apple open its doors to let 3rd party users install program for the iPhone and iTouch?
Oh wait they did but with a fine print that's 500 pages long.

Actually, jailbreaking is perfectly legal as, after you buy it, it is your property and legally yours. All it does is voids the warranty. Next time read the posts before yours .
PS. FBI is all caps. Lower case FBI looks ugly .
PSS. Where is the period at the end your sentence and the capital at the beginning?
On Topic:
